I. Definition of nouns

II. Service 

2.1. "DobiCloud" To provide you with equipment management services,You can do this through "DobiCloud" A P P Control connect to "DobiCloud" Smart terminals on the cloud platform,And enable connectivity between smart devices. The service content includes smart device management, scene coordination, analysis reports, etc.These functional services may be optimized or modified in response to changes in user needs or unilateral judgment of the service provider,Service may also be temporarily suspended due to regular, unscheduled maintenance. 

III. Scope of services 

3.1 Sanya Yinchen Enterprise Management Co., LTD grants you a right to use this product in connection with this software. 

3.2. You may not license, sell, lease, transfer, distribute or otherwise use the Products in any form. 

3. With regard to software adaptation platforms and terminal restrictions,You may use the licensed software only on licensed system platforms and terminals,If you install the licensed software on other terminal devices, you may cause damage to your hardware or software functionality. 

3.4. You shall understand that the Licensed Software may only be used for non-commercial purposes,Do not install, use, or run licensed software for commercial operational purposes. If necessary, it must be obtained in advance. "DobiCloud" Written authorization and permission. 

3.5.Sanya Yinchen Enterprise Management Co., LTDThe Licensed Software and its associated features may be changed, upgraded or transferred from time to time by the limited company.New features or services may be added to the licensed software system. If there is no independent agreement for the above-mentioned new features or services,You can still obtain authorization for the respective features and services,This Agreement applies. 

3.6. You are responsible for the accuracy, reliability, completeness and legality of the input data and the legality of the way in which you obtain it.Data, information, etc. should be backed up regularly. You assume full risk of damage or loss of such data. 

3.7. You should safeguard your account and password,If you find a security risk to your account (including but not limited to a user password leak),Timely notification should be given. "DobiCloud" ， "DobiCloud" We will assist you in taking relevant measures. Otherwise,You are responsible for all actions under your account,And you bear all responsibility. 

IV. THIRD PARTIES 

4.1. You already know "DobiCloud" Some of the Services may be used based on software or services provided by third parties,The service is set up to provide convenience to you,The legal authorization of that third party was obtained. 

4.2. "DobiCloud" Contains some of the information and services of third parties. "DobiCloud" We do not control and are not responsible for third party information and services. 

4.3. You understand "DobiCloud" There can be no assurance that the licensed software will permanently use or include such services,Nor can we guarantee that we will continue to use other software provided by the same third parties in the future.We may also use similar services from other third parties,Once the corresponding software or services are enabled,The provisions of this treaty shall also apply. 

V. Use of service specifications 

5.1. You should regulate the use of the licensed software,The following ways are in violation of usage guidelines: 1) publishing or sharing computer viruses, worms, malicious code, software that intentionally damages or alters computer systems or data; 2) In the absence of authorization,Collecting information or data from other users,Examples include email addresses, etc.; 3) malicious use of this product in an automated manner,The server causes undue burden or otherwise interferes with or damages the website server and network links; 4) In the absence of reimbursement,Attempt to access server data or communication data of this product; 5) interrupt or disrupt the use of this product by other users. 

5.2. You understand and agree to: 1) "DobiCloud" A determination will be made as to whether you are suspected of violating the above usage specifications,We may suspend, terminate your licenses of use or impose other restrictions that may be imposed in accordance with this Agreement in the light of such determination. 2) For information that you post while using the licensed software that is suspected to be illegal or suspected of violating the legal rights of others or violating this Agreement, "DobiCloud" It will be deleted directly. 3) If your breach of the above usage specifications causes damage to any third party,You need to be independently liable in your own name,It should also ensure that "DobiCloud" Without incurring losses or additional costs as a result,otherwise "DobiCloud" We have the right to recover from you. 4) If you violate the applicable law or the provisions of this Agreement,send "DobiCloud" Have suffered any damage,You should pay compensation "DobiCloud" The resulting losses and / or costs incurred. 

VI. Norms for the content of information 

6.1 You undertake not to use the Service for any unlawful or improper activity,This includes, but is not limited to, the following actions: 

6.1.1. Upload, transmit or share information that contains one of the following: 1) against the fundamental principles established by the Constitution; 2) endangers national security,Leaking state secrets,Subverting state power,Destroys national unity; 3) Where it harms the honour and interests of the State; 4) incites ethnic hatred, ethnic discrimination or undermines ethnic unity; 5) Undermine the State's religious policy,Advocates of cults and feudal superstitions; 6) Spread rumors,Disrupting the social order,They destabilize society; 7) Disseminating obscene, pornographic, gambling-related, violent, homicidal, terroristic, or inciting-to-crime content; 8) Insult or defame others,Any infringement of the legitimate rights of others; 9) Contains content that is false, fraudulent, harmful, coercive, infringing on the privacy of others, harassing, assaulting, insulting, vulgar, obscene, or otherwise morally objectionable; 10) Includes other content that is restricted or prohibited by Chinese laws, regulations, rules, regulations and any other regulations that have the force of law. 

VII. PRIVACY POLICY AND DATA 

7.1. VIII. DISCLAIMER TERMS

8.2. You understand,For direct or indirect losses to you due to force majeure and third party causes, "DobiCloud" I cannot accept responsibility. 

8.3. You are solely responsible for any personal injury or incidental or consequential damages arising from or in connection with any of the following: 1) Unauthorized use of licensed software by third parties or changes to your data; 2) Costs and losses arising from the use of licensed software; 3) Your misunderstanding of the licensed software; 4) Non-cause "DobiCloud" Other losses related to licensed software arising from causes. 

8.4. Non-Biblical "DobiCloud" or Sanya Yinchen Enterprise Management Co., LTD  Any other software derived from the unlicensed software licensed and officially released by the Limited is illegal,Download, install, and use such software,Could lead to unpredictable risks,Legal liability and disputes arising therefrom "DobiCloud" It's nothing to do with that, "DobiCloud" You have the right to suspend or terminate your license and / or all other services. 

8.5. You are aware of the use "DobiCloud" The platform involves Internet services,Could be affected by unstable factors at various points,although "DobiCloud" Security measures have been taken,The Service may still be unavailable due to inherent defects in Internet and electronic communications and times beyond the reasonable control of either party to this Agreement (including, without limitation, fires, Disasters, interruptions, delays, restrictions or inability to use occurred due to floods, terrorist attacks, plagues, natural disasters, riots, terminal viruses, hacking attacks, network failures, terminal failures). You hereby take these risks on your own initiative,Agrees that the actual occurrence of the above-mentioned risk events will affect the normal operation of the service "DobiCloud" There is no liability to you. 

IX. Termination and liability for breach of contract 

9.1. You should understand the use "DobiCloud" The Services shall use the licensed software according to the authorized scope, respect the intellectual property rights of the software and the contents of the software package, use the software according to the specifications, and fulfill the obligations under this Agreement. If you seriously violate this Agreement, "DobiCloud" The use license will be terminated. 

9.2. Your use of the Software depends on "DobiCloud" The affiliated companies provide support services to you,If you violate this agreement, "DobiCloud" The terms, agreements, rules, notices and other relevant provisions of the affiliated companies may prevent you from using the licensed software properly. "DobiCloud" You have the right to terminate your use license. Or the manner in which the Agreement provides for your use of licenses and otherwise "DobiCloud" Restrictions on controllable interests,This includes suspending or terminating your use permission. 

9.3. If you violate this Agreement or with "DobiCloud" The agreement of other agreements concluded, "DobiCloud" You can be notified. "DobiCloud" Affiliated companies,Ask them to impose restrictions on your rights,This includes asking an affiliate to suspend or terminate the provision of some or all of the services to you,Also, the website on which it operates or actually controls your breach is legally publicized. 

9.4. The licensed software is downloaded by you from the downloading platform,You are required to comply with the download platform, system platform, and end-user vendor's agreements regarding the ways and restrictions on your use of the licensed software.If the above-mentioned third party confirms that you are in breach of the agreement, you need to "DobiCloud" Well, i'm going to deal with that, "DobiCloud" Your use permission may be terminated at the request of a third party. 

9.5. At the termination of this use license,You should stop using the licensed software and destroy all copies. 

9.6. If you violate the terms of this Agreement,to "DobiCloud" Or a loss caused by other users,You must be held fully liable. 

X. Jurisdictional law and segregation 

10.1. The validity, interpretation, modification, enforcement and dispute resolution of this Agreement shall be subject to general international commercial and / or industry practice.
